Throughout these Terms, “we”, “us” and “our” refer to Kube Studio / MOTIMATION LTD.
2. Acceptance of Terms
By engaging our services, purchasing a product, or making payment to us, you agree to be bound by these Terms & Conditions.
If you do not agree, you must not use our services.
3. Our Services
We provide digital services including but not limited to:

Website design & development
-
Branding & digital design
-
Website hosting
-
Website maintenance & support
-
Domain procurement & management
-
SEO and marketing services
All services are provided on a contractual basis agreed in writing.
4. Quotes & Payments
4.1 Quotes
All quotes are valid for 14 days unless otherwise stated.
4.2 Deposits
For website projects, a non-refundable deposit (typically 50%) is required before work begins.
4.3 Final Payment
Final payment is due prior to website launch or handover.
4.4 Recurring Services
Hosting, maintenance and other recurring services are billed monthly or annually in advance via Stripe, Direct Debit or agreed payment method.
Failure to pay may result in suspension of services.
5. Domain Names
When we purchase a domain on your behalf:

The domain is registered to you where possible.

Domain fees are non-refundable once registered.

We are not responsible for domain renewal failures if payment details are not maintained.
Domain purchases are considered digital goods and cannot be cancelled once processed.
6. Refund Policy
Due to the digital nature of our services:

Deposits are non-refundable once work has commenced.

Domain registrations are non-refundable.

Completed design work is non-refundable.

Hosting fees are non-refundable once the billing period has started.
If a project is cancelled by the client after work has begun, the client is responsible for payment for work completed up to that point.
Nothing in these Terms affects your statutory rights under UK law.
7. Client Responsibilities
You agree to:

Provide content, images and feedback in a timely manner.

Ensure you have rights to any materials supplied to us.

Review and approve work promptly.
Delays in providing materials may extend project timelines.
8. Intellectual Property
Until full payment is received:

All designs and materials remain the property of Kube Studio.
Once paid in full:

The client receives full rights to the final website design.

We reserve the right to display completed work in our portfolio.
9. Hosting & Maintenance
If we provide hosting:

We aim for high uptime but do not guarantee uninterrupted service.

We are not liable for third-party outages (e.g. hosting provider downtime).

Clients are responsible for maintaining login security.
Maintenance does not include major redesigns unless agreed separately.
10. Limitation of Liability
To the maximum extent permitted by law:

We are not liable for indirect or consequential loss.

Our total liability shall not exceed the total amount paid by the client for the relevant service.
We are not responsible for loss of revenue, profits, business, or data.
11. Termination
We may suspend or terminate services if:

Payments are overdue
-
These Terms are breached
-
We are required to do so by law
Clients may terminate recurring services with 30 days’ written notice unless otherwise agreed.
12. Data Protection
We process personal data in accordance with our Privacy Policy.
13. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales
14. Payment Processing
Payments are processed via regulated third-party providers including GoCardless.
We do not store full card or banking details.
By making payment, you also agree to the terms of the relevant payment processor.
